Can You Rent to Family Members on Section 8? Rules Explained
August 05, 2024 • Compliance Team
The General Rule
Under HUD regulations (24 CFR 982.306(d)), a Housing Authority must not approve a unit if the owner is the parent, child, grandparent, grandchild, sister, or brother of any member of the family.
The Exception: Reasonable Accommodation
There is only one exception: If the PHA determines that approving the rental is necessary as a reasonable accommodation for a family member who is a person with disabilities.
For example, if you have a wheelchair-accessible unit and your disabled brother cannot find other accessible housing, the PHA may grant a waiver. This requires formal documentation and approval before lease signing.
